So looking into this a bit more (I am relying on other people to be the exp=
erts=E2=98=BA) OpenStreetMap can use CAPAD 2014 under the CC-BY licence con=
ditions without any extra permissions from the department or from the contr=
ibuting agencies. The CC-BY Non Commercial licence is actually the more res=
trictive licence limiting use to non commercial users.

Marine CAPAD 2012 and 2014 does have a commercial use warning (it is not a =
restriction as such as it is still available under CC-BY). The metadata rea=
ds.. Commercial users: Commercial users should note the availability of a m=
ore descriptive dataset for Commonwealth Marine Reserves. It is recommended=
 for use in commercial applications as it includes additional information a=
bout management arrangements for Commonwealth Marine Reserves. This dataset=
 is available under Creative Commons Attribution Non-Commercial license fro=
m:

We have also been granted permission from the contributing agencies of CAPA=
D to release the older versions under the same CC-BY licensing. Which means=
 that you can include these in OpenStreetMap when they become available.  I=
t will take a little while as we need to update all of the metadata on FED =
so keep an eye out for them in the coming months.

Now I don=E2=80=99t claim to be expert in this field=2C but I was hoping th=
at it would be possible to obtain some form of special permission to use th=
e CC-BY licensed data from CAPAD in OpenStreetMap. One such example can be =

d.gov.au_explicit_permission>. Is this possible for the CAPAD data or would=
 it be better to contact the relevant agencies which contributed to the com=
pilation?

Can I ask- is all data required to be published under an Open Database Lice=
nse (ODbL)<http://opendatacommons.org/licenses/odbl/>? I notice that in the=
 License/Contributor Terms that users will be able to use the data for comm=
ercial purposes (These rights explicitly include commercial use=2C and do n=
ot exclude any field of endeavour). Unfortunately=2C this will mean that we=
 will be contravening our agreements with the CAPAD contributors and as suc=
h we would need to release the data under the Creative Commons Share Alike =
licence for inclusion in the Open Street Map.



Given that it has taken a number or years for the department to gain agreem=
ent to release the data under CC-BY=2C I suspect that it will be a while be=
fore we are able to release the data under less restrictive conditions.

The creative commons licensing for CAPAD is a negotiated agreement between =
the Commonwealth and the contributing agencies. It is a process that takes =
some time to resolve (in some cases years).

 there are any restrictions for the inclusion on the contributions page.

You said in your email that OpenStreetMap could use your datasets 
without any extra permissions from the department. However the 
OpenStreetMap view is that we require explicit permission from the 
rights holder to use CC-BY data in OSM. Which leads to two questions:

1. Does this listing on the Contributors page:

https://wiki.openstreetmap.org/wiki/Contributors#Department_of_the_Environment_and_Energy

meet the requirement of giving the Department of the Environment and 
Energy appropriate credit under the terms of the CC-BY licence?

2. Which version of the CC-BY licence do you use? The CC-BY licences 
require that a link back to the licence text is provided but this 
requires knowing which version that is.

Thank you for your query regarding the CC-BY licensing arrangements for
CAPAD 2014 and its inclusion in OSM.

I can confirm that the Department provides permission for OSM to use
both the *terrestrial* and *marine* versions of CAPAD 2014 - as you have
identified on the OSM contributors page -
https://wiki.openstreetmap.org/wiki/Contributors#Department_of_the_Environment_and_Energy


The data download is licensed under the: CreativeCommons Attribution 3.0
Australia License.

It is worth noting that CAPAD is updated every 2 years (...and we are
expecting CAPAD 2016 to be available within the next 6 weeks) - so it's
worth checking back every few years to see what's available. This is
going to be particularly relevant in the marine environment as there
will be significant zone boundary redefinitions appearing in CAPAD 2018.

[Please note that the Department has now made all previous versions of
both terrestrial and marine CAPAD available under the CreativeCommons
Attribution 3.0 Australia License - should OSM want to make those
available also. Details of these can be found by going to
http://www.environment.gov.au/fed/ and typing in 'CAPAD' into the search
function.]

Is is possible at this stage to say whether or not the Department would 
be prepared to give OpenStreetMap access to the future editions of CAPAD 
under the same terms? Or would this require further negotiation with the 
data providers?

Ah...good question!

Our intention is that all future versions of CAPAD also come under the
CC-BY licensing model - and in line with departmental policy it will be
CC-BY 4.0 international license. Now that all previous versions of CAPAD
are available and it is Australian Government policy to make data
publicly available I don't see how we're ever going to wind back to the
days of data license agreements (and having to negotiate with individual
data providers).

Currently our metadata systems are coded in such a way that we are only
able to release under the CC-BY 3.0 Australian license. We are aware of
this shortcoming and at present don't have the resources to make this
change to our system. It's on our 'to do' list and may have something in
place by the end of the calendar year.

I think it would be good to check back with DoEE (or whatever we may be
at the time) in a couple of years - ie. early 2019 when CAPAD 2018 is
due for release - to ensure we're all good for OSM to continue to use CAPAD.

I was more thinking about the 2016 release given that you're expecting 
it to be available so soon. As I understand it the requirements for 
using CC-BY 4.0 in OSM is the same as 3.0, that is the rights holder has 
to agree that the listing on the Contributors page meets the 
requirements of acceptable credit. I was hoping that if this was OK for 
the 2014 version it would also be OK for the 2016. There would have to 
be two entries because of the two version of CC-BY something along the 
lines of what GA asked for:

If you wanted to make this only for the 2016 edition then we would make 
it clear that someone would have to check back with the Department 
before using the 2018 edition.

Ok - I see.

I've had a bit more of a think about this and the Department provides
permission for the 2014, *and any subsequent version* of CAPAD (marine
and terrestrial) to be used by OpenStreetMap.
