Services can discriminate

We currently have the sentence "the license requires us not to discriminate against any use"

This isn't really true when it comes to setting up a data/tile service. Derivative works must not have different/more restrictive licensing placed on them "You may not offer or impose any terms on the Derivative Works that alter or restrict the terms of this License". But the license doesn't say that people running a server are compelled to provide their service to anyone who wishes to use and abuse it. When it comes to people hammering requests at your server, you can be as discriminatory as you like. You can even charge for it.
